I have realized something that has scared me a little. We are so dependent on electric power that it’s almost impossible to imagine what life would be like without it. Experts warn that we may soon find out.

Your family could find themselves trapped and shivering when the heat goes out, and hungry when your refrigerated foods all spoil. They’ll have no TV, no radio, no computers, no cell phones.
If you depend on a well for water, you’ll be out of luck since pumps can’t work without electricity. Without water you can’t even flush a toilet. And without electricity to run their pumps, gas stations will shut down, too.
There’s no shortage of threats to the grid. The age of the system is a problem in itself. It was never really designed to be secure. Basically, it’s a patchwork of many independent and municipal power suppliers now largely controlled via the Internet.
Experts describe it as having so many weaknesses that a hacker could sit at a terminal on the other side of the globe and successfully take over computers that control power stations all across the United States.
There are any number of terror groups – ISIS, Al Qaeda, even entire countries like North Korea – that would love to see America brought to her knees. Thanks to the deplorable condition of the country’s electric grid, it could be done without a single bullet being fired.
The attacks have begun. A USA TODAY analysis of federal energy records found that the grid is struck by a physical or cyber attack every four days. We don’t hear about most of these attacks, but some we do.
Perhaps the best known was the one on a Pacific Gas & Electric substation in San Jose, California. Shooting for 19 minutes, snipers managed to destroy 17 giant transformers that provided essential power as far away as Silicon Valley. It took workers 27 days to restore the facility. No arrests were made.
Former CIA official Dr. Peter Pry warns, “There is an imminent threat from ISIS to the national electric grid and not just to a single U.S. city.” Dr. Pry says that attacks on just 9 of the nation’s 55,000 electrical substations could result in nationwide blackouts for up to 18 months.
Veteran newsman, Ted Koppel, goes into detail about these threats in his recently released book, Lights Out. What he has to say about the dangers from an EMP (electromagnetic pulse) weapon should be a wake-up call for the administration which so far seems to be doing very little to defend the grid.
Weather is another enemy. There is the constant threat that Mother Nature could strike a vicious blow to the grid. Remember the Polar Vortex? Only through a massive effort by grid operators were we spared total blackouts across large parts of the country.
Bottom line: Take action now and your family won’t be totally helpless when the power goes out. And it will go out.

There are some good answers here already, but I’ll point out a few of the best features that I don’t see mentioned:
1. Taxes are very low (13% maximum on income, 5% typical, zero property tax) and you get free medical and dental care. If you have a small child who is sick, a doctor will make a house call the same day at no charge to you.
2. The focus in schools is on education. There are no football teams, cheerleaders, jocks or any of the other things that make bright and hard working students feel like they are the losers. If you are a smart child in a Russian school, you are admired – even if you have thick glasses and can’t throw a ball.
3. As someone else here pointed out, you have much more actual freedom than Americans would even want these days. You see teenagers drinking beer on the streets in front of police, who don’t care as long as they aren’t drunk. You see 20 year old guys with 16 year old girlfriends, and they aren’t branded as criminals. It’s a matter for parents to get involved with – or not. If you have a business and violate some ordinance, you can usually fix it by paying the inspector directly. This is perceived as a bribe by the West, but it isn’t. The inspectors make almost no salary. They are motivated to do their job by finding violations that they can collect fines from business owners over. The owner is free to refuse to pay and take the matter to court, but then if they lose, they pay ten times as much. Still, if the violation is total BS, then they will go to court and the inspector can lose their job over it, so false allegations are rare. It’s just a different system, and actually more efficient.
4. The streets are safe. Children walk to school on their own. They play in parks on their own. There are no car jackings, or drive by shootings, or children getting their hands on guns and shooting each other. Guns are tightly regulated, and the type of criminal who is so powerful as to have a gun, isn’t going to be flashing it around holding up random nobodies. That’s someone who’s the bodyguard of a millionaire.
5. Public transportation is faster, cheaper and safer than driving. For me to get to the other side of Saint Petersburg by car takes about 3 hours these days because of traffic. A bus comes in front of my door every 3–4 minutes where I can get to a subway station and be at my destination in less than 30 minutes. No homeless people. No gangs. No religious lunatics. Anyone of those types gets hauled off by the police quickly, keeping the system perfectly safe and clean.
6. The cost of living is very low overall. The exceptions being children’s toys and clothing, which are very expensive compared to the USA. However, food is dirt cheap and the quality is much better.

In the US, when a police officer enforces the law incorrectly, is it still illegal to disobey him?

The correct answer to this question will be infuriating to a lot of people. In the ears of a lot of people, this answer will sound self-serving and overly authoritarian coming from a cop. I understand that. All I ask, for anyone who feels that way, is that they at least read to the end and consider the points I’ll do my best to explain.
Yes, it is illegal to resist the officer, even when he is wrong. It is illegal to resist arrest even when you know you’re innocent. It is illegal to resist arrest even when you know the cop is making the arrest for something which is not illegal.
In the example scenario, it doesn’t sound like the officer was making an arrest. Instead, he was enforcing a law against trespassing by requiring the customer with the dog to stop trespassing (leave the restaurant) and then letting the person go without an arrest. In other words, “I’ll give you a warning in lieu of arrest, but you have to stop trespassing right now by leaving the restaurant.” It is illegal to resist the officer in this scenario as well, even when he is wrong – even if the customer wasn’t actually trespassing by remaining in that restaurant with a service dog without authority.
What I’ve listed so far are facts – not my opinion. They are slightly oversimplified facts, rather than a book-length treatise on all aspects of the applicable statutes in all 50 states and a close examination of all relevant case law. A lawyer might point out some technicalities, but for common, everyday purposes what I have said so far is inarguable fact about what the law says. Even if some dislike that law, that’s what the law says.
Once we’ve accepted what the law actually says, we can move on to a discussion about what the law should say. The rest of this is nothing more than my own opinion. The following is the part where the reader can judge whether I have an authoritarian personality disorder.
The restaurant owner and the customer are having a dispute. This dispute centers on two mutually-exclusive propositions:
The restaurant owner has the right to throw out the customer because the customer brought a dog.
The customer has the right to resist the owner’s efforts to throw her out of the restaurant.
These two propositions are mutually exclusive. NEITHER party to the dispute is willing to just “give up” and allow the other to break the law in this fashion. Only one of them can be “right.” There are ONLY two ways to resolve this issue:
One party convinces the other, through rational discussion, that her opinion of what the law says is correct, and the other party is convinced and complies with the law.
The two parties each persist in their beliefs, and the ONLY way to resolve it is with physical force (even if that “force” is only the act of “remaining” in the restaurant, which the owner sees as a violation of HER right to prohibit dogs in the restaurant).
Since, in this scenario, we know that neither party was willing to accept the judgement of the other party, we are left with ONLY the option of physical force.
But wait! Our disputing parties live in civilization! Civilization has provided an alternative to this physical force. As long as the two parties are willing to wait a few minutes (or more) before resolving this dispute, they can call a Peace Officer. That’s an old fashioned term for a cop, and the reason the term “peace officer” was coined was for situations exactly like this one. The peace officer, a disinterested third party, can serve as a mediator between the two parties and tell them what the law actually says. Violence is avoided, the party who was in the wrong apologizes, and civilization is saved. Yay!
Oh, one problem. What if one party or the other isn’t convinced by the peace officer’s rational arguments about his opinion? Well. . .crud. Now we’re right back where we started. Instead of having a dispute between the original two parties which can only be resolved by violence, we’ve just substituted a situation where we have such a dispute between one of the parties and our peace officer.
Now, we all know that there IS an objective answer here about which party is in the right and which party is in the wrong. However, we can only arrive at that answer by appealing to authority. One such authority is a law book. We could read the law and make our decision based upon that. However, laws are just words, open to interpretation. Our two parties might disagree upon how to interpret that law. One party might point to a different law and claim that it takes precedence in a situation such as this one. The other party might point to various past cases where the courts have set a precedent for which way such arguments should be decided. Looking at those past decisions is ALSO an appeal to authority. Unfortunately, all of this arguing, when done right, takes a ton of time, a ton of expertise, and a ton of preparation. So, we can’t appeal to that kind of authority to resolve our dispute tonight, in the restaurant.
Lacking the ability to have a really productive argument about the objective answer to who is in the right in this situation, we still have to figure out some way to resolve it – preferably without any physical violence. If a compromise can’t be reached, then somebody is going to win, and somebody is going to lose.
A really good peace officer might try to find some mechanism of compromise which both parties can accept. That’s not always possible though. We’ll just say that in this situation the parties remain completely at odds with one another despite any efforts to rationally convince them.
We have reduced this situation to one where the only options are “giving in” or using force.
Now, one may be able to convince a peace officer that he is wrong, but he is probably as sure about his opinion of what the law says as the dog-owning customer is sure she is right about hers. One of them is wrong, but they both think they’re right.
The peace officer can’t give up and just leave. That’s not a realistic option. If he does that, he leaves the original two parties back where THEY started, with no option but force. They called him in the first place to avoid that, and he is worse than useless if he abandons them to that option.
We are absolutely stuck with a situation where the only option is some application of force between the peace officer and whichever one of the original disputing parties he decided was “in the wrong.” There is absolutely no other way to resolve this issue.
Since there is absolutely no point even having peace officers if they are required to “give up” when one party to the dispute disagrees with them AND
Since laws which made it legal to physically resist peace officers once they’ve made a decision would completely undercut the entire purpose of peace officers, which is to avoid violence. . .
We can determine that if having peace officers is to be of any use at all, then we must have laws which make it illegal to physical resist their judgement on the street.
This is true even when the officer is, objectively, wrong. SOMEBODY in these disputes is ALWAYS wrong. SOMEBODY had to get the final say in what is going to happen if we are to avoid violence. Somebody has to be *shudder* that “final authority” on the street. We would like to think that final authority should be whoever was “right” in their arguments about the original disupute, but it is impossible to determine which person was “right” in an argument out on the “street” (or in a restaurant) when everybody thinks they’re “right.”
Reality leaves us with only two options. We can just encourage the disputing parties to “fight it out,” or we can provide an arbiter and require both parties to abide by his judgement for the time being until it can be resolved later, non-violently, in court if necessary.
Some might argue that there should be some “higher authority,” some extra agency, over and above that first peace officer to whom the parties can appeal if one of them doesn’t like the peace officer’s decision – maybe even as simple as a supervisor – a police sergeant. This only accomplishes one thing though. It just means that ONE of the two original parties now disagrees with that sergeant, and is faced with the decision of abiding by the sergeant’s decision or physically resisting. So, we’ll add another layer. We’ll bring in the lieutenant. Now ONE of the parties (maybe the same one, maybe not) will be at odds with the lieutenant and have to decide whether to give in or resist. We can even add in a whole separate agency which can be called to decide on the case, and we still end up with the same, basic situation: Eventually somebody has to have the final say, and the law has to prohibit the parties from resisting THAT person. It’s “final authority” or violence. Those are the only options when the two sides can’t be convinced by argument.
I basically just described a system where we have a bunch of “intermediate” level peace officers whose word is NOT final. I described a situation where the party who disagrees with the original cop can call for different cops, working up chain until, finally, they get to the last one in the chain, the one with the “final authority” to decide whether force should be used to protect the customer’s right to stay in the restaurant, or whether force should be used to protect the owner’s right to have that dog OUT of her restaurant. Even in this situation, that “final authority” person, whatever title you want to give him, must really be the final authority for that night under the law, or else he is useless and we should have just let the owner and customer fight it out in the first place. What’s more, that “final authority” person made all of those “lower level” officers pointless and a waste of time, because OF COURSE the disputing parties would insist on an officer of “the next level” before complying with the original officer if they didn’t like his decision. All of the “lower level” officers who do not have “final authority” are useless. We should just skip them and only put the “final authority” guys and gals on the street to avoid wasting everyone’s time with the intermediate steps. That’s what we do.
So, if I’m to be honest with myself and avoid trying to put a “spin” on my own arguments, I must say that this is my argument for why police officers must be allowed the “authoritarian” ability to make decisions such as the one in the example and why it must be illegal to resist them when they do so, even if they’re wrong. Yes, it’s “authoritarian,” but it’s “authoritarian” as a last resort to violence rather than as a personal quest for power due to a personality disorder.
The cops are going to be wrong sometimes. That, absolutely, can not be avoided. Our choice is to have laws which require people to comply with that wrong decision, or else have no such laws and allow anyone who thinks the cop was wrong to fight. It’s a decision between occasional miscarriage of justice and complete anarchy. If the cops get it wrong ALL the time, or even MOST of the time, then the anarchy argument starts to gain some ground. As long as we’re only getting it wrong every once in awhile, it’s better for that poor woman with the service dog to be improperly kicked out of the restaurant than to have a law which allows everyone to fight the police when they think the police are wrong.

MY LIFE Other’s give up…
I remain as active as I can in a very limited comfort zone. Some see me as strong and resilient — a few know the inner turmoil of my life. I do not believe I am unique and I know that some consider me lucky in that there are many worse off than me. I sometimes reflect on this. As well tell them there pain is nothing to be compared to so many others that suffer 24×7 daily!
Lately I do feel that I am becoming a burden to my close friends — this manifests itself in many ways: acute sensitivity, neediness, and argumentativeness. Especially after the death of an adopted grand son, which was closely more a friend and family
member than anything else. Gave up because life was always against him as well as friends and even family most of his life.
So if I were to take my life, it would go down as a veteran suicide, but what does that tell anyone? Yes, I am a veteran and yes, these afflictions are the result of my exposure to Agent Orange 50 years ago, but so what, really, so what? I am not special.
So, what is it that has prevented me from saying, “Fuck it all, this sucks”? Several reasons:
A small group of young friends who I can count on almost every day to stay in touch and who allow me to have a meaningful role in their lives. It is sometimes enough and sometimes not enough — some understand and some don’t. One even gets on my nerves daily when he gets on weed or anything else these young people say they need to deal with life. Deal with life? I do as my VA doctor tells me, well to the most part anyways.
Some hope that I may relocate to be near the small family that I remain in touch with and to see, for a while, my youngest grandson grow a bit and to see my oldest grandson, when he is able to leave his job for time off.
Some hope that if I do not relocate I will find some meaning up here — but I doubt it — all that there is up here is convenience to continue to be “comfortably uncomfortable” and to delude myself with magical thinking. Fighting the forces to be that try to take what is mine with tricks and whatever else they come up with. As a Viet Nam veteran I was trained to fight for right to live and hold my ground. I still do just that and have no need to, just a challenge that other vets of my era would only understand. Our oath as well is still in all of us no matter what anyone may say.
And the existential fear that a suicide may fail or that there really is some awful fate waiting after death — who knows. I can wait while suffering daily, after all death is final, life is to continue on at all costs as there is only one life for us all.

I write this because in some small way I want to shed some sunshine of reality into a dark area and perhaps add to the question of what are the signs, and what, if anything, can be done. I still wonder myself. Even after Billy’s death and why still alive to keep him alive until that last day. Not to mention my high school and college friends that have as well passed on before me.
I say again that I am not special because I am a veteran — I am just another old geezer on his way out — living in the days of past glory.
It is not enough to be strong enough to stand alone; you must be brave enough to ask for help.
And for as long as you can: Make your legs move each morning despite the unknown.

Central Ar/Heat units on a hand shake…
Kinty Jones Heating & Cooling:
$4, 380.00 finally paid off with only a handshake and word that I would pay payments of $150.00 a month until paid in full. Credit was not great so of course no help there what so ever. Now, in the heat of the summer and no way of cooling off, let alone knowing no heat for the winter if I did not get whatever was needed to be repaired. When hearing the price and other options I settled for the following.
I always speak out against bad business people as well as great business people. Took three men to remove the old unit and replace with the new unit along with a ten year warranty even. Had to come up with $600.00 cash and that was not easy, but after borrowing here and there finally made it. Even before I made the down payment or good faith amount, the guys were tearing out the old central unit and puting in the new one. Next was cool cold aair then winter and auto light for the gas for the heat. If see that gal in the yellow pages, ” My dad can fix anything”, Kinky JonesHeating and Cooling can fix anything. Plus work with anyone that is on hard times as well.

I doubt you will ever read this.
We had an intense and wonderful relationship. We were exclusive and happy. You came from an abusive marriage, and I had to help show you that you are worth something. That you shouldn’t blindly submit to the man in your life because providing him pleasure, regardless of your pain, “only lasts a few moments out of your entire life”.
I loved you fiercely, with every part of my being. Then you came to me, the day after I change your sons diaper, the day after we had amazing sex. You want to be sure, you never want to divorce again. So you want to date other people.
You broke my heart, for days I couldn’t look at you without crying, feeling confused and betrayed. When I ask to talk to you, you shut me out. I never yelled at you, never got angry, would never dream of laying a hand on you.
I texted you, tried calling you. Just to talk and understand why. I decided against every fibre in my being to try and be one of the guys that you date while you discover yourself. When we kissed, you said it wasn’t the same and decided for me I couldn’t handle it. In the end, you have blocked my phone number and blocked me from Facebook.

Randall Smith of Marysville, California that is funny as hell tell the gay roomers to sue me for telling the world that they are gay as well as posting there photo’s. Randall here is the legal wording for someone that probably has not even completed high school to understand. My blog of news of the truth is just that. Using your name is truth as your also on here. The Bloggers’ FAQ on Online Defamation Law provides an overview of defamation (libel) law, including a discussion of the constitutional and statutory privileges that may protect you.
What is defamation?
Generally, defamation is a false and unprivileged statement of fact that is harmful to someone’s reputation, and published “with fault,” meaning as a result of negligence or malice. State laws often define defamation in specific ways. Libel is a written defamation; slander is a spoken defamation.
What are the elements of a defamation claim?
The elements that must be proved to establish defamation are:
a publication to one other than the person defamed;
a false statement of fact;
that is understood as
a. being of and concerning the plaintiff; and
b. tending to harm the reputation of plaintiff.
If the plaintiff is a public figure, he or she must also prove actual malice.
Is truth a defense to defamation claims?
Yes. Truth is an absolute defense to a defamation claim. But keep in mind that the truth may be difficult and expensive to prove.
Can my opinion be defamatory?
No—but merely labeling a statement as your “opinion” does not make it so. Courts look at whether a reasonable reader or listener could understand the statement as asserting a statement of verifiable fact. (A verifiable fact is one capable of being proven true or false.) This is determined in light of the context of the statement. A few courts have said that statements made in the context of an Internet bulletin board or chat room are highly likely to be opinions or hyperbole, but they do look at the remark in context to see if it’s likely to be seen as a true, even if controversial, opinion (“I really hate George Lucas’ new movie”) rather than an assertion of fact dressed up as an opinion (“It’s my opinion that Trinity is the hacker who broke into the IRS database”).
What is a statement of verifiable fact?
A statement of verifiable fact is a statement that conveys a provably false factual assertion, such as someone has committed murder or has cheated on his spouse. To illustrate this point, consider the following excerpt from a court (Vogel v. Felice) considering the alleged defamatory statement that plaintiffs were the top-ranking ‘Dumb Asses’ on defendant’s list of “Top Ten Dumb Asses”:
A statement that the plaintiff is a “Dumb Ass,” even first among “Dumb Asses,” communicates no factual proposition susceptible of proof or refutation. It is true that “dumb” by itself can convey the relatively concrete meaning “lacking in intelligence.” Even so, depending on context, it may convey a lack less of objectively assayable mental function than of such imponderable and debatable virtues as judgment or wisdom. Here defendant did not use “dumb” in isolation, but as part of the idiomatic phrase, “dumb ass.” When applied to a whole human being, the term “ass” is a general expression of contempt essentially devoid of factual content. Adding the word “dumb” merely converts “contemptible person” to “contemptible fool.” Plaintiffs were justifiably insulted by this epithet, but they failed entirely to show how it could be found to convey a provable factual proposition. … If the meaning conveyed cannot by its nature be proved false, it cannot support a libel claim.
This California case also rejected a claim that the defendant linked the plaintiffs’ names to certain web addresses with objectionable addresses (i.e. http://www.satan.com), noting “merely linking a plaintiff’s name to the word “satan” conveys nothing more than the author’s opinion that there is something devilish or evil about the plaintiff.”
Is there a difference between reporting on public and private figures?
Yes. A private figure claiming defamation—your neighbor, your roommate, the guy who walks his dog by your favorite coffee shop—only has to prove you acted negligently, which is to say that a “reasonable person” would not have published the defamatory statement.
A public figure must show “actual malice”—that you published with either knowledge of falsity or in reckless disregard for the truth. This is a difficult standard for a plaintiff to meet.
Who is a public figure?
A public figure is someone who has actively sought, in a given matter of public interest, to influence the resolution of the matter. In addition to the obvious public figures—a government employee, a senator, a presidential candidate—someone may be a limited-purpose public figure. A limited-purpose public figure is one who (a) voluntarily participates in a discussion about a public controversy, and (b) has access to the media to get his or her own view across. One can also be an involuntary limited-purpose public figure—for example, an air traffic controller on duty at time of fatal crash was held to be an involuntary, limited-purpose public figure, due to his role in a major public occurrence.
Examples of public figures:
A former city attorney and an attorney for a corporation organized to recall members of city counsel
A psychologist who conducted “nude marathon” group therapy
A land developer seeking public approval for housing near a toxic chemical plant
Members of an activist group who spoke with reporters at public events
Corporations are not always public figures. They are judged by the same standards as individuals.
What are the rules about reporting on a public proceeding?
In some states, there are legal privileges protecting fair comments about public proceedings. For example, in California you have a right to make “a fair and true report in, or a communication to, a public journal, of (A) a judicial, (B) legislative, or (C) other public official proceeding, or (D) of anything said in the course thereof, or (E) of a verified charge or complaint made by any person to a public official, upon which complaint a warrant has been issued.” This provision has been applied to posting on an online message board, Colt v. Freedom Communications, Inc., and would likely also be applied to blogs. The California privilege also extends to fair and true reports of public meetings, if the publication of the matter complained of was for the public benefit.
What is a “fair and true report”?
A report is “fair and true” if it captures the substance, gist, or sting of the proceeding. The report need not track verbatim the underlying proceeding, but should not deviate so far as to produce a different effect on the reader.
What if I want to report on a public controversy?
Many jurisdictions recognize a “neutral reportage” privilege, which protects “accurate and disinterested reporting” about potentially libelous accusations arising in public controversies. As one court put it, “The public interest in being fully informed about controversies that often rage around sensitive issues demands that the press be afforded the freedom to report such charges without assuming responsibility for them.”
If I write something defamatory, will a retraction help?
Some jurisdictions have retraction statutes that provide protection from defamation lawsuits if the publisher retracts the allegedly defamatory statement. For example, in California, a plaintiff who fails to demand a retraction of a statement made in a newspaper or radio or television broadcast, or who demands and receives a retraction, is limited to getting “special damages”—the specific monetary losses caused by the libelous speech. While few courts have addressed retraction statutes with regard to online publications, a Georgia court denied punitive damages based on the plaintiff’s failure to request a retraction for something posted on an Internet bulletin board. (See Mathis v. Cannon)
If you get a reasonable retraction request, it may help you to comply. The retraction must be “substantially as conspicuous” as the original alleged defamation.
What if I change the person’s name?
To state a defamation claim, the person claiming defamation need not be mentioned by name—the plaintiff only needs to be reasonably identifiable. So if you defame the “government executive who makes his home at 1600 Pennsylvania Avenue,” it is still reasonably identifiable as the president.
Do blogs have the same constitutional protections as mainstream media?
Yes. The US Supreme Court has said that “in the context of defamation law, the rights of the institutional media are no greater and no less than those enjoyed by other individuals and organizations engaged in the same activities.”
What if I republish another person’s statement? (i.e. someone comments on your posts)
Generally, anyone who repeats someone else’s statements is just as responsible for their defamatory content as the original speaker—if they knew, or had reason to know, of the defamation. Recognizing the difficulty this would pose in the online world, Congress enacted Section 230 of the Communications Decency Act, which provides a strong protection against liability for Internet “intermediaries” who provide or republish speech by others. See the Section 230 FAQ for more.
The vast weight of authority has held that Section 230 precludes liability for an intermediary’s distribution of defamation. While one California court had held that the federal law does not apply to an online distributor’s liability in a defamation case, the case, Barrett v. Rosenthal, was overturned by the California Supreme Court (EFF filed an amicus brief in this case)
Can I get insurance to cover defamation claims?
Yes. Many insurance companies are now offering media liability insurance policies designed to cover online libel claims. However, the costs could be steep for small blogs—The minimum annual premium is generally $2,500 for a $1 million limit, with a minimum deductible of $5,000. In addition, the insurer will conduct a review of the publisher, and may insist upon certain standards and qualifications (i.e. procedures to screen inflammatory/offensive content, procedures to “take down” content after complaint). The Online Journalism Review has an extensive guide to libel insurance for online publishers.
Will my homeowner’s or renter’s insurance policy cover libel lawsuits?
Maybe. Eugene Volokh’s the Volokh Conspiracy notes that homeowner’s insurance policies, and possibly also some renter’s or umbrella insurance policies, generally cover libel lawsuits, though they usually exclude punitive damages and liability related to “business pursuits.” (This would generally exclude blogs with any advertising). You should read your insurance policy carefully to see what coverage it may provide.
What’s the statute of limitation on libel?
Most states have a statute of limitations on libel claims, after which point the plaintiff cannot sue over the statement. For example, in California, the one-year statute of limitations starts when the statement is first published to the public. In certain circumstances, such as when the defendant cannot be identified, a plaintiff can have more time to file a claim. Most courts have rejected claims that publishing online amounts to “continuous” publication, and start the statute of limitations ticking when the claimed defamation was first published.
What are some examples of libelous and non-libelous statements?
The following are a couple of examples from California cases; note the law may vary from state to state. Libelous (when false):
Charging someone with being a communist (in 1959)
Calling an attorney a “crook”
Describing a woman as a call girl
Accusing a minister of unethical conduct
Accusing a father of violating the confidence of son
Not-libelous:
Calling a political foe a “thief” and “liar” in chance encounter (because hyperbole in context)
Calling a TV show participant a “local loser,” “chicken butt” and “big skank”
Calling someone a “bitch” or a “son of a bitch”
Changing product code name from “Carl Sagan” to “Butt Head Astronomer”
Since libel is considered in context, do not take these examples to be a hard and fast rule about particular phrases. Generally, the non-libelous examples are hyperbole or opinion, while the libelous statements are stating a defamatory fact.
How do courts look at the context of a statement?
For a blog, a court would likely start with the general tenor, setting, and format of the blog, as well as the context of the links through which the user accessed the particular entry. Next the court would look at the specific context and content of the blog entry, analyzing the extent of figurative or hyperbolic language used and the reasonable expectations of the blog’s audience.
Context is critical. For example, it was not libel for ESPN to caption a photo “Evel Knievel proves you’re never too old to be a pimp,” since it was (in context) “not intended as a criminal accusation, nor was it reasonably susceptible to such a literal interpretation. Ironically, it was most likely intended as a compliment.” However, it would be defamatory to falsely assert “our dad’s a pimp” or to accuse your dad of “dabbling in the pimptorial arts.” (Real case, but the defendant sons succeeded in a truth defense).
What is “Libel Per Se”?
When libel is clear on its face, without the need for any explanatory matter, it is called libel per se. The following are often found to be libelous per se:
A statement that falsely:
Charges any person with crime, or with having been indicted, convicted, or punished for crime;
Imputes in him the present existence of an infectious, contagious, or loathsome disease;
Tends directly to injure him in respect to his office, profession, trade or business, either by imputing to him general disqualification in those respects that the office or other occupation peculiarly requires, or by imputing something with reference to his office, profession, trade, or business that has a natural tendency to lessen its profits;
Imputes to him impotence or a want of chastity.
Of course, context can still matter. If you respond to a post you don’t like by beginning “Jane, you ignorant slut,” it may imply a want of chastity on Jane’s part. But you have a good chance of convincing a court this was mere hyperbole and pop cultural reference, not a false statement of fact.
What is a “false light” claim?
Some states allow people to sue for damages that arise when others place them in a false light. Information presented in a “false light” is portrayed as factual, but creates a false impression about the plaintiff (i.e., a photograph of plaintiffs in an article about sexual abuse, because it creates the impression that the depicted persons are victims of sexual abuse). False light claims are subject to the constitutional protections discussed above.
What is trade libel?
Trade libel is defamation against the goods or services of a company or business. For example, saying that you found a severed finger in a particular company’s chili (if it isn’t true).
